Terms and Conditions

1. Introduction

Welcome to Elite Client Solutions (“Elite Client,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our online platform, including our website, directory, and booking services (collectively, the “Platform”). By accessing or using the Platform, you (“you” or “User”) agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Platform.

2. Services

Elite Client Solutions operates as a support service for sex workers in Queensland, Australia, providing tools and expertise in client communication, marketing, and booking management. We offer a directory for clients to browse and a booking platform to make online bookings.

3. User Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old.1

4. User Conduct

You agree to use the Platform in a lawful and respectful manner. You shall not:

  • Use the Platform for any illegal or unauthorized purpose.
  • Engage in any harassing, abusive, or discriminatory behavior.
  • Use the Platform to transmit any unsolicited or unauthorized advertising or promotional materials.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt2 the Platform or servers or networks connected to the Platform.
  • Violate any applicable local, state, national, or international law3 or regulation.

5. Account Management

If you create an account on the Platform, you are responsible for maintaining the confidentiality of your account and password and for restricting4 access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You agree to provide accurate and complete information when5 creating an account and to update your information as necessary to keep it accurate and complete.6

6. Bookings and Payments

Elite Client Solutions operates on a commission-based revenue model for service providers. Depending on the level of support, the commission percentages are 25%, 30%, and 40%. This is accepted by the client as a deposit, and the rest of the payment is paid to the service provider on arrival. There are no upfront costs or hidden fees for service providers. Deposits are taken by PayID, Beemit, Stripe, or bank transfer. It is the service provider’s sole responsibility to accept payment for their services on arrival.

7. Cancellations and Refunds

If a client cancels a booking prior to arriving for service and a deposit is paid, the deposit will be paid to the service provider. If the client cancels 24+ hours before the booking, the deposit is refunded. If the client cancels within the 24-hour timeframe, the deposit is paid to the service provider. If the client wants to reschedule, they can only do so 24+ hours before the booking time and date; the deposit will be held for the new date. If the second booking is canceled or rescheduled, the deposit will be paid to the service provider. If a deposit is not paid, the booking is not confirmed. A refund of the deposit will only be made if a client’s booking is canceled by the service provider at any time.

8. Disclaimer of Warranties

Elite Client Solutions makes no warranties or representations about the accuracy or completeness of the Platform’s content or the content of any sites linked to the Platform.7 We do not endorse any service providers listed on the Platform and are not responsible for the quality of their services.

9. Limitation of Liability

Elite Client Solutions will not be liable for any damages of any kind arising from the use of the Platform, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.8

10. Indemnification

You agree to indemnify and hold9 harmless Elite Client Solutions and its affiliates, officers, directors, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising10out of your use of the Platform, your violation of these Terms, or11 your violation of any rights of another.

11. Termination

Elite Client Solutions may terminate your access to all or any part of the Platform at any time, with or without cause, with or without notice, effective immediately.12 You may terminate your account at any time by contacting us at agency.eliteclient@gmail.com.

12. Governing Law

These Terms shall be governed by and construed by the laws of Queensland, Australia, without regard to its conflict of law provisions.

13. Entire Agreement

These Terms constitute the entire agreement between you and13 Elite Client Solutions relating to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written,14between you and Elite Client Solutions with respect to the Platform.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and15 effect.

15. Changes to Terms

Elite Client Solutions reserves the right to modify these Terms at any time. We will post the most recent version of the Terms on the Platform and note the date of the latest revision. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
